Not So Welcome Home
Surveillance of The Lambs

Apparently the right to FREE SPEECH in Brevard County is reserved for the few of Sheriff Wayne Ivey’s choosing. As a local journalist, I’m not on the “FLORIDA BAD ASS'” list of those deserving of a First Amendment right in , but Eddie Riffone repeatedly and falsely accusing me of committing acts of violence against my neighbors puts me squarely on the Tattooed, Cartoon Sheriff’s High Intensity Target List. S.H.I.T. LIST. Get It?

Florida Statute § 837.05 (False Reports to Law Enforcement Authorities): Knowingly giving false information to a law enforcement officer concerning the commission of a general crime is a first-degree misdemeanor. However, it escalates to at least a third-degree felony when EDWARD RIFFONE, in a knowingly false statement, accused me of a second-degree (violent) felony.
Federal Civil Rights Lawsuit (Section 1983): Under 42 U.S.C. § 1983 individual officer
Federal Civil Rights Lawsuit (Section 1983): Under 42 U.S.C. § 1983, you can sue the individual officer for violating your constitutional rights. Your lawsuit would simultaneously claim:
False Arrest / Unlawful Seizure: Arresting you without legal probable cause (violating the Fourth Amendment).
Excessive Force: Inflicting physical injuries during the arrest.
Fabrication of Evidence: Deliberately falsifying a police report, violating my First Amendment right to FREE SPEECH, and taking me to jail, being another attack on the residents liberty, living in the Bella Vista 2 neighborhood, under VESTA PROPERTIES’ governance, and the ROCKLEDGE POLICE infringing of my right to due process. PROBABLE CAUSE, MY INNOCENT ASS! Bypassing “Qualified Immunity”: Knowing well that police officers are heavily shielded by qualified immunity, they are so obviously guilty (recorded, ironically, with their own bodycams) that there’s no way to can escape accountability. knowingly fabricating a report to They have no immunity for writing a false report, because as is stated in Florida law, a “reasonable officer” would know LYING IS A CLEAR VIOLATION OF THE LAW.
Compensatory Damages (medical expenses, lost wages, and pain and suffering) Punitive Damages, which are heavily levied out of the officer’s pocket to punish malicious intent and willful misconduct.
Criminal Prosecution Against the Officer
Falsifying a police report and using illegal force are crimes, though the decision to prosecute lies with government lawyers.
STATE CHARGES: Local prosecutors (the District Attorney) can charge the officer with state-level crimes. Depending on the jurisdiction, these include filing a false police report, perjury, tampering with public records, official misconduct. (Felony Assault for damage to my left hand)
FEDERAL CHARGES: If local prosecutors refuse to act, a report can be filed with the U.S. Department of Justice (DOJ) Civil Rights Division or the FBI. The federal government actively prosecutes officers for Obstruction of Justice under 18 U.S.C. § 1519 (writing a false report to conceal misconduct) and Deprivation of Rights Under Color of Law under 18 U.S.C. § 242 (which is elevated to a felony if physical injury occurs).
Administrative and Internal Disciplinary Actions While a lawsuit handles the compensation, and criminal charges handle jail time, internal oversight handles their employment.
Internal Affairs (IA) Complaint: Filing a formal complaint triggers an investigation by the agency’s internal affairs unit. If the investigation sustains the allegations, the officer faces termination, suspension, or demotion.
Decertification: In most states, if an officer is fired for intentional deception or dishonesty (often referred to as a “Brady violation”), their behavior is reported to a state licensing board. They can be permanently stripped of their peace officer certification, meaning they can never work in law enforcement again.
Tampering with Governmental Records/ Falsifying Official Documents: Writing lies in an official incident report or booking affidavit constitutes altering or creating a false government document, which is a felony in many jurisdictions.
Perjury: If the false report is signed under oath, affirmation, or penalty of perjury (such as in a sworn arrest warrant affidavit or probable cause statement), the officer commits perjury.
Obstruction of Justice/ Fabricating Evidence: Falsifying documents to mislead an investigation or subvert the judicial process is charged as obstructing justice.
Official Misconduct/Abuse of Power: Most states have specific criminal statutes for public servants who act with intent to obtain a benefit or deprive another person of their constitutional rights by using their official authority unlawfully.
No Expectation of Privacy: In the United States, individuals working outdoors in plain view (such as on a lawn visible from the street or a neighbor’s property) have no reasonable expectation of privacy.
Right to Record: A homeowner is entirely within their legal rights to photograph or film activity happening on or around their own property.
The Workers’ Video: Ironically, by videotaping the encounter, the workers may have inadvertently documented their own unlawful actions, which can be subpoenaed or used as evidence.
Notify the Business Owner / Corporate Office: If the letter came from an individual or a small crew, notifying the broader company ownership (if it is a larger franchise or corporation) often results in the immediate termination of the hostile workers to mitigate the company’s liability.
No matter Bella Vista 2 Homeowners Association president Edward Riffone, Vesta Properties, Robertson’s Landscaping, Myers Landscaping, and the Rockledge Police Department surveilling, swatting, and slandering me, I AM NOT A DANGEROUS RACIST, I DON’T OWN A GUN, AND I HAVE A FIRST AMENDMENT RIGHT TO TAKE A PICTURE IN MY NEIGHBORHOOD.
I was clear-eyed when my wife Kathy and I decided to move back to Rockledge (my hometown), and I knew I’d be living next to a more than fair share of stupid, but I was surprised when that stupid extended so deep into the Rockledge Police Department. So many young officers who know little of the community (Florida’s Space Coast) their paid to “protect” and “serve.” And most sad, that they lack an understanding of an American citizen’s First Amendment right to FREE SPEECH.
Maybe I shouldn’t have been surprised. Watching Brevard County, “FLORIDA BAD ASS”, Sheriff Wayne Ivey in his tough-guy, Tic Tok cartoons, encourage neighbors to SURVEIL their neighbors, looking to build his data base, from which he’ll choose to make “targets” on his “SHIT LIST.” Isn’t Ivey so cute? With his “Sheriff’s High Intensity Target” list. Isn’t that funny?
But it’s NO FUCKING JOKE, when he revs up the little, anal retentive, Trump-worshipping, “I’M THE HOA PRESIDENT” types, who LIE “FREELY,” to describe a neighbor they deem “undesirable,” a neighbor they SURVEIL, SWAT, SLANDER, ASSAULT, and BATTER, with hopes of getting that neighbor on Ivey’s oh, so popular, “SHIT” LIST.
NOT SO FUCKING FUNNY, when the local police are so First-Amendment ignorant, that they don’t understand that (photo) journalism is a right I’m guaranteed, NOT ILLEGAL. And coming into my neighborhood, walking into my yard, and videotaping with a cell phone is CRIMINAL SURVEILANCE.
To Remind you, I don’t own a gun, I am not a racist, and a victim of every crime, perpetrated by ALL the individuals and organizations listed below.
